Can state reject NRC,CAB,CAA??
- From every TV channels to Newspapers we continuously here & read that some of the state of India will be not going to apply NRC,CAA,CAB and NPR. But central govt is screaming about the fact that every state is bound to apply this Act. As per their word this was passed in parliament & so it is constitutional.This is why everyone has to maintain that.
- So now the question is " CAN STATE DENY THAT??"
- So for understanding that we have to go to the history pages
In the year of 1976 , 42nd amendment was done in Amendment Act. Then the congress was in the power & Indira Gandhi was ruling the party.
They inserted the clause no 4 & 5 in the article 368 under the section 55 of constitution Act.- So now the question is what was in the amendment??
It was said that if central govt pass any Act so its is constitutional & NO ONE can challenge that
& also said "IT CAN BE CHALLENGED"
so as per the current scenario Kerala challenged it in supreme court.Now it is going to be judgmental & will decide by apex court itself.
From 22nd January ,2020 this case will be started.
